1. Service Provider
These Terms and Conditions (“Terms”) govern your use of Kaiju (“Service”), provided by Lionel Rudaz, located at Chemin des Côtes 76, 1020 Renens, Switzerland (“we,” “us,” or “our”).
2. Service Description
Kaiju is a project management system that integrates with Jira to help manage initiatives and projects across different teams. The Service accesses your Jira users, issues, and releases data through Jira&apso;s API.
3. Data and Privacy
- We only store links to your Jira data and user identification information
- We do not store actual Jira content on our servers
- We are GDPR compliant and process data in accordance with applicable data protection laws
- Data is hosted on Vercel and Supabase servers in Western Europe
- Upon account deletion, all your data is immediately and permanently deleted
4. Free Trial and Subscription Plans
- New users receive a 30-day free trial
- After the trial period, continued use requires a paid subscription
- We offer Seed, Grow, and Scale plans with monthly or yearly billing
- Yearly subscriptions receive a 20% discount
- Trial data remains accessible after the trial period ends
- All subscriptions auto-renew unless cancelled
5. Payment Terms
- Payments are processed securely through Stripe
- We accept credit card payments
- Billing occurs monthly or yearly based on your selected plan
- Failed payments trigger a 7-day grace period before service suspension
- You are responsible for maintaining current payment information
6. Refund Policy
Refunds are available within 7 days of purchase. Contact us to request a refund.
7. Prohibited Use
You may not use Kaiju for:
- Illegal activities or purposes
- Reverse engineering or attempting to access our source code
- Competitor analysis or benchmarking
- Spam or unsolicited communications
- Resource abuse or excessive API usage
- Any activity that violates these Terms
8. Account Termination
We reserve the right to terminate your account immediately for:
- Non-payment after the grace period
- Violation of these Terms
- Illegal use of the Service
- Engaging in prohibited activities listed above
9. Support
Technical support is available via our Contact us page. We respond to all inquiries within 2 working days.
10. Service Availability
- We strive to maintain high service availability but provide no uptime guarantees
- We may perform maintenance that temporarily affects service availability
- We are not liable for service interruptions beyond our reasonable control
11. Limitation of Liability
To the maximum extent permitted by Swiss law, our total liability for any claims arising from your use of Kaiju shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email to your registered address. Continued use of the Service after notification constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by Swiss law. Any disputes will be resolved in the courts of Renens, Switzerland.
